End User License Agreement (EULA) for Konstrakta Stickers APP

PLEASE READ THIS END USER LICENSE AGREEMENT ("EULA") CAREFULLY.

THIS AGREEMENT GOVERNS YOUR USE OF THE KONSTRAKTA STICKERS MOBILE APPLICATION ("SOFTWARE") PROVIDED BY KONSTRAKTAVERSE ("LICENSOR").

BY INSTALLING AND/OR USING THE SOFTWARE, YOU ("LICENSEE") ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THE TERMS OF THIS EULA. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST UNINSTALL AND CEASE ALL USE OF THE SOFTWARE IMMEDIATELY. THIS EULA IS AVAILABLE FOR REVIEW WITHIN THE SOFTWARE.

1. License Grant

Subject to the terms of this EULA, Licensor grants Licensee a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Software solely for personal, non-commercial purposes on a mobile device owned or controlled by Licensee.

2. Restrictions

Licensee agrees not to:

a) Modify, adapt, translate, reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software;

b) Rent, lease, lend, sell, sublicense, assign, distribute, publish, transfer, or otherwise make available the Software to any third party for any reason;

c) Remove, alter, or obscure any proprietary notices (including copyright or trademark notices) of Licensor or its suppliers contained in the Software.

3. Intellectual Property

The Software is licensed, not sold. Licensee acknowledges that Licensor (Konstraktaverse) retains all right, title, and interest in and to the original content of the Software, including all stickers, user interface design, and any other creative assets produced by Konstraktaverse.

The stickers included in the Software are original works by Konstraktaverse and are distributed free of charge for personal use within this application.

If the stickers are used separately in any other products, services, or creative works, attribution must be provided as follows: "Stickers by Konstraktaverse".

4. Open Source Components (BSD License)

Parts of the Software are based on open-source code published by WhatsApp Inc. and its affiliates under the BSD 3-Clause License.

This includes code functionality related to WhatsApp Sticker integration and basic app structure.

A full copy of the BSD License is included in Appendix A of this Agreement.

These components remain the intellectual property of their original authors and are separate from the original artwork and functionality developed by Konstraktaverse.

5. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED TO LICENSEE "AS IS" AND WITH ALL FAULTS AND DEFECTS WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, LICENSOR, ON ITS OWN BEHALF AND ON BEHALF OF ITS AFFILIATES AND ITS AND THEIR RESPECTIVE LICENSORS AND SERVICE PROVIDERS, EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LICENSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES OF ANY KIND, INCLUDING LOSS OF PROFITS OR DATA, ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE SOFTWARE.

IN NO EVENT SHALL LICENSOR’S TOTAL LIABILITY EXCEED THE AMOUNT PAID FOR THE SOFTWARE, WHICH IS DISTRIBUTED FREE OF CHARGE.

7. Term and Termination

This EULA remains effective until terminated. It will terminate automatically if Licensee fails to comply with any of its terms. Licensee may terminate it by uninstalling and deleting all copies of the Software. Sections 3–5 and 8 will survive termination.

8. Entire Agreement

This Agreement constitutes the entire agreement between Licensee and Licensor regarding the Software. It supersedes any prior or contemporaneous understandings.
